MetaLife’s Privacy Policy was created to reaffirm our commitment to the privacy and security of the information we collect from our customers and any users of the communication channels used by MetaLife, such as WhatsApp, social networks, among others. (“User(s)”).

This policy covers the treatment that MetaLife gives to information capable of identifying Users who browse the website, as well as collecting information from those who fill out the electronic registration forms available on the website for the purposes provided therein, such as contacting us, opening calls, requesting quotes, registering technicians, among others.

By accessing the Website or any MetaLife Channels, the User expresses his/her free acceptance of the terms of this Privacy Policy, authorizing the collection of the data and information mentioned herein, as well as their use for the purposes specified below.
If the User does not agree with the terms and conditions below, he/she must discontinue access to the Website or the MetaLife Channels.

This document is an integral part of the Terms of Use and Navigation Conditions of the Virtual Store, the rules of which are applicable exclusively to the Virtual Store area of ​​the website and, in the event of a conflict between the provisions of both documents, the most specific provision on the subject must prevail.

1. Definitions

The MetaLife Virtual Store is the area of ​​the website dedicated to the sale of products, whose domain is https://metalifepilates.com.br.

MetaLife Channels are any and all electronic communication channels used by MetaLife, such as WhatsApp, social networks, chats, among others. (I fixed the word WhatsApp)

The company Metalife Furniture Industry and Commerce LTDA is called “MetaLife”.

All those who, in some way, access the MetaLife website or Channels are classified as “Users”.

All people who purchase products and/or services offered by the MetaLife Online Store, whether paid or not, are classified as “customers”.

Individual identification is understood as any information that is not available to the general public and is attributed, in a personalized manner, to a specific customer/user. Examples of individual identification data include CPF or CNPJ numbers, contact details and billing data.

A cookie is a text file sent by the MetaLife website server to the User’s computer for the purpose of identifying the computer, customizing access and obtaining browsing data, such as pages visited or links clicked. A cookie is assigned individually to each computer, it cannot be used to execute programs, nor infect computers with malicious code of any kind, such as viruses, Trojans, etc., and can only be read by the server that sent it.

Encryption is the name given to the process of encoding information. Information is encoded (scrambled) at the source and decoded at the destination, making it difficult to decipher while it travels across the Internet.

Firewall: is the name given to the physical and/or logical device of a computer network that aims to apply a security policy to a specific control point on the network. Its function is to regulate data traffic between different networks and prevent the transmission and/or reception of harmful or unauthorized access from one network to another.

2. Purpose of requesting personal information by the MetaLife website

2.1. One of MetaLife’s main guidelines is respect for the User and their privacy in compliance with the Brazilian Federal Constitution and the General Personal Data Protection Law. Thus, the MetaLife website is committed to keeping your personal information collected through the website or MetaLife Channels completely confidential, linking it only to your registration and using it for the following purposes:

(i) In the Online Store:
a) Registration as a customer;
b) Enable online purchase of products from the Online Store;
c) Deliver and bill for products and services purchased, as well as identify the respective recipient;
d) Collect statistics to study and identify the profile of our customers and develop our campaigns;
e) Maintain data and customer relationship actions, as well as continuously improve the service provided.

g) Send newsletters and advertising messages.

c) Sending newsletters and advertising messages;
d) Contacting the User to offer MetaLife products.

2.2. The information requested from Users is the minimum necessary for the website’s functionalities to achieve their purposes, as set out above.

2.3. The user guarantees the veracity and accuracy of the information and data provided when registering on the MetaLife website or accessing the MetaLife Channels, assuming the corresponding responsibility if they are not accurate, and undertakes to keep them updated. MetaLife assumes no responsibility in the event of damages caused by inaccuracy of the data provided or fraud in its content.

2.4. Users who register on the website or MetaLife Channels using third-party data may be committing crimes of false identity, fraud or other more serious crimes, without prejudice to any liability in the civil sphere.

2.5. The user may, at any time, request changes and/or corrections to their data, by simply accessing their registration directly through authentication in the MetaLife Virtual Store or via email  at lgpd@metalife.com.br .

3. Registration and storage of personal data and information

3.1. All personal data collected will be incorporated into the company’s database, which will be responsible for correct storage, in accordance with the relevant legislation.

3.2. The data of customers using the Online Store will be stored from the date of the User’s registration. Once the purchase is made, the data will be kept in MetaLife’s database for a minimum period of 5 (five) years after the end of the warranty period for each piece of equipment purchased, and MetaLife is also authorized to keep the customer’s contact details for the purposes set forth in items 2.1 (i) “e”, “f” and “g”. For the other features of the website and on the MetaLife channels, MetaLife will store the collected data for an indefinite period, and Users may claim their rights as data owners under the General Data Protection Law, in particular, the deletion of their data, by sending an email to  lgpd@metalife.com.br .

3.3. Payment method data added by Users in the Virtual Store area are protected by encryption, in accordance with the Payment Method Market rules stipulated by the Card Brands.

3.4. MetaLife may confirm the personal data provided by the user by consulting public entities, specialized companies, and lawful databases, for which it is expressly authorized. Such action, however, does not cease or diminish the user’s responsibility for the accuracy and veracity of the data provided, which is why MetaLife may, at its sole discretion, suspend or cancel the user’s registration at any time if it detects any inaccuracy.

4. Obtaining navigational information and cookies

4.1. MetaLife also automatically receives and stores information on its servers about activities arising from the browser, including the IP address and the page accessed, through cookies.

4.2. Cookies allow the recognition of computers that access websites and monitor the user’s navigation within our page, in order to personalize it according to each customer’s profile. Cookies do not store any personal information; they only contain the user’s login data. In any case, you can delete cookies from your computer whenever you wish or configure your internet browser to reject them. We warn, however, that this last option may limit some of the functions of the MetaLife website.

4.3. Other technologies may be used to obtain browsing data from Internet users. However, they will always respect the terms of this policy and the collection and storage options.

5. Use of information

5.1. Without prejudice to the other provisions described in this policy, the user declares to be aware of and agrees that MetaLife may use the information collected for the following general purposes:
(a) to enable interactivity between the client user and the administrator user;
(b) to inform about new events;
(c) to keep user records up to date for purposes of contact by telephone, email, direct mail, SMS or other means of communication;
(d) to improve usability and the interactive experience during the user’s navigation on the Portal;
(e) to prepare general statistics, without identifying users;
(f) to guarantee the security of visitors and respond to their eventual questions or requests;
(g) to establish, defend or regularly exercise rights in the judicial or administrative sphere;
(h) to conduct research and communication and relationship marketing campaigns, as well as to disclose offers from partners.

6. Data protection and privacy

6.1. MetaLife will do everything possible to maintain the privacy of its users’ personal data stored in its database, committing to use technology that is sufficiently suitable for the protection of such data, seeking to maintain a secure environment, using appropriate tools and efficient information security controls, always observing the available state of the art, always on a best efforts basis. However, considering that no security system is absolutely secure, MetaLife is exempt from any liability for any damages and/or losses resulting from viruses, invasions of the MetaLife website, its database and other related failures.

6.2. MetaLife professionals are aware of this policy and the rules set forth in the General Data Protection Law, and only qualified and authorized personnel are permitted to access users’ personal data collected, under penalty of disciplinary sanctions in the event of a violation of the rules set forth herein. If the User becomes aware of any data breach committed by MetaLife professionals, they may file a complaint at  lgpd@metalife.com.br .

7. Sending communications and advertising messages

7.1. MetaLife may send communications and advertising messages daily, at its sole discretion, to its registered users, or customers in general, using all types of technologies and means of communication available, whether by email, SMS, MMS, direct mail, among others.

7.2. Communications, newsletters, offer notices and advertising messages sent by e-mail will necessarily include an option for MetaLife to cancel the sending of that type of message. The cancellation of the sending may also be requested by e-mail to  lgpd@metalife.com.br . The request will be fulfilled within the minimum time necessary to carry out this execution, observing the maximum period of 15 (fifteen) days.

7.3. Opt-out is done via the user’s email. Therefore, users who have more than one registration may continue to receive communications or advertising messages in the email that was not unsubscribed.

7.4 Email sending services may be carried out by MetaLife or by a contracted company, which will use its own servers to carry out the sending.

7.5 The contracted company does not store, nor use in any way, the User’s e-mails registered on the MetaLife website for any purpose other than sending messages, in accordance with the preferences of each registered user and the provisions set forth in this Privacy Policy and in the Portal’s Terms of Use.

8. Disclosure of Data

8.1. User data may be shared with marketing partners to send advertising materials and information, as well as with companies that provide technical assistance services for pilates equipment, when purchased by Users, and also with the sales channels used by MetaLife.

8.2. Except as provided above, MetaLife does not share, sell or disclose personal information collected from users. MetaLife may also disclose user information (i) if required to do so by law, regulation or legal process (such as a court order or subpoena), (ii) in response to requests by government agencies, such as law enforcement authorities, or (iii) when it believes disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity. MetaLife reserves the right to transfer any user information in the event of a sale or transfer of all or a portion of its business or assets (including in the event of a reorganization, dissolution or liquidation).

9. Rights of data subjects

9.1. MetaLife guarantees the data subject the right to exercise the rights provided for in applicable law, including: (i) confirmation of the existence of processing of their personal data; (ii) access to such data; (iii) correction of incomplete, inaccurate or outdated data; (iv) anonymization, blocking or deletion of unnecessary, excessive data or data processed in non-compliance with the LGPD; (v) portability of their personal data, upon express request; (vi) deletion of data processed with the consent of the data subject, in compliance with the applicable retention periods; (vii) obtaining information about public and private entities with which MetaLife shared their data; (viii) information about the possibility of not providing consent and the consequences of refusal; (ix) revocation of consent, under the terms of the LGPD, when applicable.

9.2. The rights of Users, as holders of the data collected by MetaLife, will be handled exclusively via email  at lgpd@metalife.com.br  and will be met within the legal deadline.

10. Modifications to our Privacy Policy

10.1. The Privacy Policy of the MetaLife website is subject to constant improvement and enhancement. Therefore, MetaLife reserves the right to unilaterally modify this Privacy Policy at any time. The new privacy rules will come into effect 10 (ten) days after their publication on the Portal. However, if Users and Clients do not agree with the new rules, they should contact MetaLife’s customer service channels, in which case their contractual relationship with MetaLife will be considered terminated, although all obligations assumed up to the time of the effective termination or cancellation of their registration with MetaLife, as the case may be, must be fulfilled.

10.2. By using features of the MetaLife website or interacting with it, the user agrees and accepts the terms of the Privacy Policy in force on that date.

11. Applicable law and jurisdiction

11.1 This Privacy Policy is governed by the legislation of the Federative Republic of Brazil.
