These Terms and Conditions of Use apply to Internet users who use the e-commerce website www.metalifepilates.com.br to purchase products and services offered.

This e-commerce site is intended to provide products and services sold directly by Metalife.

By purchasing products on this e-commerce site, the visitor declares to have read, understood and accepted the Terms and Conditions of Use that govern it and all other alerts and notices that may appear linked to matters covered in said Terms.

These Terms and Conditions of Use are accompanied by and form an integral part thereof: the Purchase Policy; the Product Delivery, Exchange and Return Policy; and the Metalife e-commerce Privacy Policy.

  2. The terms described below, when used in these Metalife e-commerce Terms and Conditions of Use, will have the following meanings:

3.2. The User must have legal capacity to enter into contracts, that is, be over 18 years of age or emancipated. If the User is a minor, his/her legal guardian will be responsible for the consequences of the acts performed on behalf of the User.

3.3. Users who have registered on the Metalife e-commerce site using third-party data may be liable for the crimes of false identity, fraud or other more serious crimes, without prejudice to any liability in the civil sphere.

  1. Registration, Access Account, Login, Password and Security

4.1. In order for the User to complete their purchase, they must register with the Metalife e-commerce site. Duplicate registrations made by the same User may also be canceled.

4.4. When completing the registration form, the User will choose the login and password of his/her preference, according to the system availability, and the User must pay attention to the security information, including with regard to changing and updating access passwords. If the User wishes to change his/her login and password, he/she must follow the instructions provided in the Metalife e-commerce.

4.5. The User’s login and password are personal and non-transferable, and the assignment, sale, rental or any other form of transfer of the registration is prohibited.

4.6. It is the User’s duty to ensure the safekeeping and confidentiality of their registration, being solely responsible for their login details and password, and will be responsible for all acts carried out under their access account.

4.7. The User is aware that he/she must immediately notify Metalife of any loss, theft or unauthorized use of his/her access account, as well as any breach of security of which he/she is aware. In such situations, it is also the User’s obligation to immediately change his/her password.

4.8. Metalife does not request passwords or financial information from its users or Customers by email, under any circumstances.

Metalife will always use its best efforts to keep the information it makes available on its Portal as accurate, up-to-date and complete as possible. However, it is not responsible for any inaccuracy, error, fraud, inaccuracy, insufficiency or discrepancy in the information, data, images, videos or other content related to communications.

  • Do not reach the minimum limit of 10 (ten) characters;

  • Are related to large-scale publishing practices, such as spam .

Failure to comply with these Terms and Conditions of Use authorizes Metalife, at any time, to remove the content and cancel the User’s access account, without the need for prior notice, without giving the User any right to compensation, under any circumstances.

  1. Copyright and Intellectual Property

9.1. The commercial use of Metalife as a brand, company name or domain name, as well as the contents of the Metalife e-commerce Portal screens, as well as the programs, databases, networks, files that allow the User to access and use through their account are the property of Metalife and are protected by international copyright, trademark, patent, model and industrial design laws and treaties, and their use by the User is prohibited, except with prior written authorization.

9.2. When accessing the Metalife e-commerce, the User undertakes to respect all intellectual property rights and those arising from the protection of its registered trademarks, as well as all rights relating to third parties that may be, or have been, in any way available on the Metalife e-commerce. Mere access to the Metalife e-commerce does not grant the User any right to use the names, titles, words, phrases, brands, patents, literary, artistic, literary-musical works, images, videos, symbols, among others, that are, or have been, available therein;

9.3. Reproduction of the contents described above is prohibited, except with prior written authorization from Metalife.

9.4. It is only permitted to create a temporary file of the Metalife e-commerce, and its use for commercial, advertising or any other purposes that contradict the reality for which it was designed, as defined in this Term, is prohibited. The reproduction, distribution, disclosure, adaptation, modification, use, editing, making available in any means of communication, etc., in whole or in part, of the texts, figures, and graphics that make up this Portal, without prior and express authorization from Metalife, is also prohibited. Only copies may be printed for personal use and archiving, without separating the parts that allow for a faithful and real understanding of its content and purpose.

9.5. Any other type of use of authorized material, including for editorial, commercial or advertising purposes, may only be made with the prior and express consent of Metalife.

9.6. The User assumes all and any responsibility for the improper use of information, texts, graphics, brands, works, images, videos, in short, any and all intellectual or industrial property rights of the Metalife e-commerce, both civilly and criminally.

9.7. Any reuse of authorized material must be subject to new authorization from Metalife.

9.8. Authorization to use the requested material is non-transferable to third parties, even if linked to the User, unless with prior written authorization from Metalife.

9.9. The use of the material does not authorize the User to expose third parties in a degrading or vexatious manner, create a work of an illegal, defamatory, obscene or immoral nature, which may violate ethics, morals and good customs, under penalty of incurring the penalties applicable under current legislation.

9.10. Any use not covered by this authorization will be considered a violation of copyright and subject to the applicable sanctions under Law 9.610, of February 19, 1998, which protects copyright in Brazil.

9.11. The eventual withdrawal of any advertisement, article, video, news or photograph reproduced by Metalife e-commerce as a result of any complaint, should always be understood as a demonstration of our intention to avoid pending issues in relation to this matter and, never, as recognition of any infringement by Metalife of the rights of a third party or of having any fault for the occurrence.

9.12. The photos and images used in the Metalife e-commerce may not reflect their original size or current situation of the reproduced scene, and are merely illustrative.

  1. User Responsibilities

10.1. Metalife adopts all measures to ensure the information and security of its Users. Therefore, the User assumes all the burdens and responsibilities arising from the acts performed on the Metalife e-commerce site and by third parties performed on their behalf, through the use of their access account.

10.2. The User is solely responsible for the information provided or disclosed on the Metalife e-commerce site.

10.3. The User undertakes to indemnify Metalife for any losses and damages caused as a result of its actions or omissions that violate the provisions contained in current legislation, the Terms and Conditions of Use of Metalife e-commerce or its integral Policies.

  1. Exclusion of Warranties and Liability

11.1. Metalife uses the best and most modern technologies on its Portal for the security of its Users. However, due to operational issues and outsourcing of services, Metalife e-commerce may be subject to occasional interruptions, technical failures and temporary unavailability of operation. Whenever reasonably possible, Metalife will provide prior notice of interruptions to the operation of its e-commerce to its Users.

11.2. Metalife is exempt from any liability for damages and losses of any nature that may arise from the lack of availability or continuity of the e-commerce operation.

11.3. Metalife is not responsible for any damage or loss resulting from the sending of information or advertising content that has not been sent by the Metalife website itself, whether the latter are legitimate or unwanted ( spam ).

11.4. Unless proven to be in bad faith, Metalife shall not be liable for any case in which human, mechanical or systemic error occurs that may result in the alteration of data or information relating to products, including prices shown on the website . In the event of an error, the customer will be promptly notified by email, telephone or through Metalife’s online Self-Service platform about the situation, and may choose to cancel their order or have it rectified, in accordance with the correct information. In the event of order cancellation, the transaction will be cancelled and any amounts paid by the customer will be promptly refunded.

11.5. In all promotions and partnerships, the discounts contained on our website will not be cumulative, that is, when faced with two or more promotions or discounts, it will be necessary to choose the one(s) that best suits you, exempting Metalife from any responsibility in this regard.

11.6. When requesting a product return, please check whether there is any personal item that was used as a test , to prevent it from being sent together with the item being returned to the Distribution Center. If you have any questions about what was sent, please contact us.

11.7. Metalife is not responsible for any personal products erroneously returned together with Metalife products purchased through e-commerce in the event of exchange, replacement or purchase regret.

11.8. We would like to point out that Metalife is not responsible for any credit rejection at the time of purchase, as this is a procedure carried out by the respective Credit Card Administrator used by the Customer. We also inform you that Metalife is not aware of the reason for the credit rejection. If your purchase is rejected, please contact the administrator of the card used at the time of purchase to resolve the problem.

11.9. Metalife is not responsible for any damage, loss or harm to the User’s equipment caused by system, server or connection failures resulting from third party conduct, including actions by malicious software such as viruses, Trojan horses, etc., which may, in any way, damage the User’s equipment or connection as a result of accessing, using or browsing the Metalife e-commerce, as well as the transfer of data, files, images, texts, audios or videos contained therein.

12.a.1. Conditions and details on purchase flows and procedures are set out in the Purchase Policy, available on the Metalife e-commerce site, and an integral part of these Terms and Conditions of Use.

12.a.2. Only individuals or legal entities capable of exercising their rights and obligations in full, in accordance with Brazilian legislation and other international regulations that may be applicable, with the respective registration and creation of an access account, may use and purchase products advertised on the Metalife e-commerce site.

12.a.3. All prices and conditions of the Metalife e-commerce are valid only for purchases made on the website and do not apply to direct and telephone sales, just as the prices and conditions of direct and telephone sales are not valid for the Metalife e-commerce.

12.a.4. Upon completing the order formation, the User will receive a message from Metalife e-commerce containing the purchase data in the email account provided during registration.

  1. Payment methods and refunds

12.b.1. If the User opts for the bank slip and payment is not made by the due date of the invoice, the order will be automatically cancelled.

12.b.2. For your convenience, Metalife e-commerce offers the option of reprinting payment slips in case there are problems when printing or purchasing. Simply access the My Account Menu and, next to the order placed with the payment slip option, access the reprint link and click on “Print 2nd copy of payment slip”.

12.b.3. If you prefer to pay using a credit card, the User has the option of paying for a single product using two different credit cards, dividing the amount into two invoices.

12.b.4. Metalife e-commerce reserves the right not to work with credit cards issued abroad.

12.b.5. The User must pay attention to all payment details at the time of purchase, as even after the order has been closed it will be possible to change the payment method if the use of a Credit Card has not been successful and the User wishes to pay in another way.

12.b.6. We would like to point out that Metalife e-commerce does not request passwords or credit card details from its customers . Exceptionally, when there is a cancellation or regret of the purchase and the payment is made by bank slip or online debit, Metalife will request bank details such as the name of the bank, branch and account of its customers by email, in order to ensure due reimbursement. Therefore, we ask that Users who eventually receive an email with inappropriate or dubious content do not respond, disregard it and, if possible, forward it to crc@metalife.com.br .

  1. Delivery, exchange and return of products

14.1. The Terms and Conditions of Use of Metalife e-commerce are subject to constant improvement and enhancement.
